These Terms of Service (“Terms”) govern your use of our website, www.tyhealthspan.com (the “Site”), mobile applications, services, and all other platforms (collectively, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this requirement.
2. Services Offered
TY HealthSpan provides wellness and health-focused services, including:
DEXA Scans – body composition and bone density assessments
VO2 Max and VO2 Submax Testing – cardiovascular fitness evaluations
Resting Metabolic Rate (RMR) Testing
Health Coaching and Lifestyle Guidance
Nutritional Supplements and Membership Subscriptions
Our services are intended for wellness and educational purposes and are not medical treatments or diagnostics. Use of our Services does not establish a patient-provider relationship. All recipients of our health coaching, testing and other wellness and health-focused services will be required to execute our current form of Assumption of Risk, Release of Liability & Hold Harmless Agreement.
3. User Responsibilities
You agree to:
Provide accurate and current information relevant to your health and wellness assessments.
Disclose any medical conditions or limitations that may affect testing or participation.
Follow all pre-test, in-test, and post-test instructions.
Respect the privacy and safety of others in our facilities.
4. Appointments and Payment
Payment is required either before the service or at the time of service unless otherwise arranged.
Payments are non-refundable, except in the event that TY HealthSpan cannot perform the service as scheduled. In such cases, we will reschedule at a mutually agreeable time.
Cancellations or rescheduling require at least 48 hours’ notice.
We accept payments through secure third-party processors.
Gift cards have no cash value and are non-refundable.
5. Health Disclaimer
Our Services are general wellness assessments. They are not medical advice, diagnosis, or treatment. You should consult a licensed healthcare provider for interpretation of results or before making significant lifestyle changes. In case of a medical emergency, call 911 immediately.
6. Intellectual Property
All content, data, and materials on our website or provided through our Services are owned by TY HealthSpan or our licensors. You may use these materials for personal, non-commercial purposes only, and only in strict accordance with these Terms of Service. Unauthorized reproduction, distribution, or commercial use is prohibited.
7. Restrictions on Use
You may not:
Use the Services for unlawful or unauthorized purposes.
Reverse engineer, copy, or modify any aspect of the Services.
Transmit malware, spam, or harmful content.

TY HealthSpan may suspend or terminate access to Services at any time, with or without notice, for violations of these Terms or at our discretion. Certain provisions, including intellectual property rights and disclaimers, survive termination.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law rules.
